Personal data – Cookies

The privacy policy of JOEL FEAU and CIE (hereafter “Féau”) is likely to be updated on a regular basis. The changes to the privacy policy will apply from the first time they are posted online.

If one of the stipulations of the privacy policy were to be struck down by an Act, Regulation or final decision of a competent court, the other stipulations would keep their full force and scope.

Personal data refers to any information relating to a physical person identified or identifiable, directly or indirectly, including by reference to an identifier (name, first name, identification number, location data, etc.) or to specific elements of his or her physical, physiological, genetic, psychic, economic, cultural or social identity.

A “cookie” is a file sent to Users’ hard drive via their browser. This term covers all tracers deposited and/or read, including when viewing the Website, reading an email, installing or using a mobile software or application, regardless of the medium used.

a. Personal data collecting and processing

As Processing Manager, Féau collects, consults, stores, transmits and erases personal data to identify the Users when browsing the Website but also when Users voluntarily communicate their name, first name, mail, in the form “CONTACT” available on the Website or subscribe to Féau’s Newsletter.

Users guarantee the authenticity and the accuracy of all the data they provide on the Website via the clickable link “CONTACT” or during their exchanges with Féau and that constitute proof of these Users’ identity.

The data collected as part of the Newsletter subscription and the clickable link “CONTACT” voluntarily filled out by Users are mandatory and essential to managing Newsletter’s subscriptions and Users’ requests and claims. Users are informed that, in the absence of transmission of this personal data, Féau will not be able to grant their request. This personal data is stored on a secure database created on WordPress, exclusively accessed and used by Féau and only for the purpose of responding to Users’ requests.

Féau also uses “cookies” and/or “web tags” to adapt and optimize the Website’s display regarding the browsing preferences provided by Website Users (country, language, time zone, etc.) but also to ensure the proper functioning (functional cookies) and to analyze and measure attendance on the Website (audience cookies).

Functional cookies used by Féau are essential to the operation of the Website and to the navigation of Users since they allow Users to use the main features of the Website and secure their connection.

Users are informed that they may object to the registration of “cookies” and “web tags” by setting up their computer in accordance with the information on the CNIL website http://www.cnil.fr, within the “cookies” section.

Links on our Website can be used to access or interact with certain social networks (Facebook, Instagram, Youtube, LinkedIn, etc.) that can use “cookies” and “web tags” through the Website to collect personal data. Féau does not participate in the filing or reading of these “cookies” and/or “web tags” and does not collect or know the information collected via these “cookies” and/or “web tags“. Féau recommends that Users consult the terms of use, privacy policies and legal mentions of these social networks.

b. Legal sources for the processing of personal data

Féau only collects necessary personal data, proportionate to the legitimate and determined purposes defined in the Terms of Use and voluntarily submitted by Users, and only implements legal personal data processing on the basis of legal sources provided by the regulations:

  • Users’ Agreement (subscription to the Newsletter, various requests via the contact form completed voluntarily and beforehand by Users),
  • Pre-contracting procedures (request for quotes, etc.),
  • Respect of legal (claims, litigation, etc.), accounting and tax obligations,
  • Féau’s legitimate interests (protection and development of its activity and the Website, etc.) when the treatment does not infringe on people’s rights,
  • Combating fraud, money laundering and terrorist financing.

c. Purpose of personal data processing

Users are informed that Féau implements personal data processing for the following purposes that do not require the prior consent of Users or require information voluntarily and previously transmitted by Users:

  • To ensure the Website’s functions properly and to allow Users to navigate the Website optimally,
  • To define the language of the Website and the time zone concerned in consideration of information and preferences voluntarily provided by Users,
  • To manage and track newsletter subscriptions voluntarily subscribed by Website Users,
  • To manage and track Users’ requests (information, business projects, applications, etc.). Any User who then becomes a customer of Féau would be informed of the methods for collecting and processing additional personal data that would be necessary to manage and monitor this new contractual relationship,
  • To manage and track Users’ complaints as part of their browsing on the Website or as part of their exchanges with Féau using the clickable link “CONTACT”,
  • To manage requests for access, rectification, opposition, erasure and portability of Users,
  • To analyze and measure attendance on the Website.

No commercial offer will be made by Féau or by its business partners to Users who would inform their personal data through the clickable link “CONTACT”, except in case of express request from Users especially following a request for quotes.

d. Recipients of personal data

The personal data collected on the Website is intended for Féau and may, if necessary, be temporarily communicated to third parties performing services on behalf of Féau as part of the operation and management of the Website (computer scientist, webmaster, etc.).

Personal data collected and processed by Féau will not be transferred outside the European Union. However, should personal data be transferred outside the European Union, Féau will take all necessary measures to ensure that the countries receiving the personal data provide a level of personal data protection equivalent to that provided by the European and French provisions.

e. Time to store personal data

Personal data is collected, recorded and stored in accordance with the General Data Protection Regulations (GDPR) and with the Act n°78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties in its last version, and are kept for a limited period of time determined by the purpose of the treatment and the applicable legal and regulatory provisions.

At the expiration of these conservation periods, Féau will delete the Users’ personal data in order to comply with the applicable legal provisions without the need to obtain express and prior approval of the Users.

f. Security

In the current state of knowledge, it is technically impossible to guarantee the unfailing security of data exchanged on the open Internet network. However, Féau has taken all reasonable measures to ensure the utmost confidentiality and security of personal data collected or communicated by the Users and to protect the actions taken on the Website (antivirus, restricted access to the back office of the Website, etc.), to prevent them from being stolen, used without authorization, distorted, etc.

This personal data is only visible to qualified staff and aware of privacy issues.

In the event of a breach of personal data, Féau will notify the CNIL in the forms and deadlines provided for by the General Data Protection Regulations (GRPD) and by the Act n°78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties in its current version.

g. Users’ rights

In accordance with the General Regulations for Data Protection (GRDP) and with the Act n°78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties in its latest version in force, any User of the Website has a right of opposition or limitation to the processing of his or her personal data and a right of access, rectification and deletion of personal data concerning him or her.

Any User also has the right to receive his or her personal data (carrying personal data) in digital format when he or she has agreed for its processing or when the processing is carried out as part of the execution of a contract.
